What is a separation agreement?
A Separation agreement is a legally binding contract made between separating couples to resolve all of the legal issues arising out of a breakdown in their relationship.

Do I need a separation agreement?.

Even if you have no children and no property to divide, it is recommended that couples have a separation agreement prepared to address spousal support and ensure there is finality with legal issues so nothing can arise later on.

What does separation agreement cover?
Separation Agreements deal with the major issues including decision making and parenting time with children, child support, spousal support, and the division of property. Separation Agreement also deal with many ancillary issue such as insurance, future changes in financial circumstances or with the children, and dealing with future disputes.

Do I need a lawyer for a separation agreement?
Yes, for independent legal advice on your circumstances and on the agreement that has been drafted.  There are ways to reduce the cost of a legal fees but drafting your own separation agreement is not one of them. Separation Agreements are quite complex contracts that require very precise wording and attention to detail for them to be held up in court.  To reduce the cost of legal fees in the separation and divorce process you do not need a lawyer to draft the agreement but you do need a family law legal professional i.e. paralegal to draft the agreement. 

Do I need a separation agreement before my divorce?
Normally, yes, the court wants to make sure all of the legal issue are resolved prior to granting a divorce. It may be possible to separate the divorce from the remaining issues, but that is a complex procedure if your spouse does not agree to it.
